The divorce between Katie Holmes and Tom Cruise has now been settled. The former couple’s primary goal was to ensure the welfare of their minor daughter, Suri. Turns out that the parties have agreed that Suri should live primarily with her mother, Katie, in New York with generous visitation to her father.
In any California divorce proceeding, its an especially emotional task to hash out a reasonable child custody and visitation plan that will ensure that said parenting plan is in the best interest of the child. Luckily, Holmes and Cruise have put the custody issue and their divorce to bed. No one likes their private matters to be dragged through the mud in public.
From an Orange County divorce lawyer’s perspective, it is common for both parents to obtain joint legal custody of the child. Evidently, this was the main issue in the Holmes/Cruise divorce– that Holmes filed in New York because she wanted sole legal custody of Suri and New York is more apt to grant sole legal custody to one parent. In California, the courts are more inclined to award joint legal custody to both parents.
