According to documents filed by Bristol Palin in the Alaska Superior Court, her ex Levi Johnston is behind in child support payments to the tune of $67,000. Yet, he is requesting 50% custody. Further, Palin is alleging that Johnston does not visit the child regularly, is buying cars, taking fancy trips, spending money on hunting excursions etc.
From an Orange County Child Custody attorney’s perspective, if you not paying your court ordered child support (or are behind thousands of dollars in arrears), it is not recommended that you file a request for more custody. If you cannot pay your child support, how are you able to take care of your child 50% of the time?
Here in California, the more time you spend with the child, the less child support you have to pay. However, if you are only asking for more custody for the purpose of lowering your child support payments, you are not doing it for the right reason. Ask yourself: does the child want to spend more time with you?
